En el evento que se present\u00f3 el Proyecto Estrat\u00e9gico de Defensa
P\u00fablica y Justicia Intercultural, el director general del Instituto Federal
de Defensor\u00eda P\u00fablica, Magistrado Benjam\u00edn Rubio Ch\u00e1vez, subray\u00f3 la
importancia de contar con defensores p\u00fablicos. \u201cNo hay justicia sin
defensa. La justicia siempre requiere como aliado a personas que sean
capaces de enfrentarse al poderoso, al arbitrario, al injusto\u2026 alcanzar
la justicia requiere de personas con vocaci\u00f3n, \u00e9sas que no s\u00f3lo hacen
lo que deben hacer seg\u00fan sus manuales y horarios sino aquellas que
entregan m\u00e1s por la misma prestaci\u00f3n\u201d.
Del mismo modo, inform\u00f3 que de diciembre de 2025 a la fecha,
el IFDP logr\u00f3 la liberaci\u00f3n de 432 presos que sufr\u00edan penas
excesivas o condiciones de vulnerabilidad \u2013como enfermedades
terminales, discapacidad f\u00edsica, o ser originarios de pueblos y
comunidades ind\u00edgenas.
En cuanto a la asesor\u00eda jur\u00eddica, refiri\u00f3 que se busca la representaci\u00f3n
en temas de derechos humanos, como el acceso al agua, cobro
excesivo de energ\u00eda el\u00e9ctrica o su suspensi\u00f3n, falta de atenci\u00f3n m\u00e9dica,
entre otros.<\/p>\n\n\n\n

Durante la presentaci\u00f3n del proyecto, el presidente de la Suprema Corte
de Justicia de la Naci\u00f3n (SCJN), Hugo Aguilar Ortiz, reconoci\u00f3 la labor
de las y los defensores p\u00fablicos \u201cpor lo realizado en estos casi seis
meses de la nueva etapa de nuestro sistema de justicia\u201d.<\/p>\n\n\n\n

De la misma manera, afirm\u00f3 que en el pasado, dentro
del sistema judicial mexicano se conform\u00f3 una visi\u00f3n alejada
del servicio social. \u201cYo nada m\u00e1s me acuerdo de estas frases que est\u00e1n
colocadas en el imaginario popular: \u2018a m\u00ed no me des, ponme donde hay\u2019,
\u2018el que no tranza no avanza\u2019. Se construyeron porque el funcionario no
estaba de manera genuina comprometido con lo que le encomendaban:
hacer justicia. Estaba aprovechando el lugar para servirse y no para
servir\u201d.
En su intervenci\u00f3n, el presidente del \u00d3rgano de Administraci\u00f3n Judicial,
N\u00e9stor Vargas Solano, indic\u00f3 que el programa de preliberaciones se
desplegar\u00e1 a nivel nacional y contar\u00e1 con la participaci\u00f3n
de reclusorios, la Secretar\u00eda de Salud y la Fiscal\u00eda General de la
Rep\u00fablica (FGR).
Y Agreg\u00f3 que el prop\u00f3sito de \u201cConstruyendo puentes para acercar la
justicia\u201d, es atender los principales retos del acceso institucional a la
justicia y asegurar que \u00e9sta sea eficaz, con enfoque humano y
plenamente accesible para quienes la necesitan. Destac\u00f3 que uno de
los ejes cardinales del programa tiene que ver con la preliberaci\u00f3n de
personas de poblaci\u00f3n vulnerable cuyos antecedentes de edad o
condici\u00f3n f\u00edsica les permitan acceder a ese derecho.<\/p>\n\n\n\n

Relat\u00f3 que en su experiencia \u2013al llevar a cabo un proyecto similar en la
Ciudad de M\u00e9xico, cuando fungi\u00f3 como consejero jur\u00eddico de la capital,
y por instrucci\u00f3n de la entonces jefa de Gobierno, Claudia Sheinbaum
Pardo\u2013 se logr\u00f3 la liberaci\u00f3n de m\u00e1s de 100 mujeres \u201centre ind\u00edgenas,
personas con enfermedades terminales, personas de la tercera edad\u201d.
Por su parte, el director general del IFDP, Benjam\u00edn Rubio Ch\u00e1vez,
destac\u00f3 los tres aspectos en los que se concentra el programa, y que
van m\u00e1s all\u00e1 de la defensa penal. Ello, porque tambi\u00e9n se
brinda asesor\u00eda jur\u00eddica y asesor\u00eda jur\u00eddica intercultural.
El tambi\u00e9n autor del texto \u201cDerecho a la identidad\u201d explic\u00f3 que el tercer
aspecto busca \u201cque la defensa jur\u00eddica tenga coherencia con la reforma
del art\u00edculo 2 constitucional [el cual reconoce a los pueblos y
comunidades ind\u00edgenas y afromexicanas como sujetos de
derecho p\u00fablico, que entre otros derechos reconoce los sistemas
normativos ind\u00edgenas con defensores que hablen la lengua y que sean
int\u00e9rpretes de las culturas y esos sistemas\u201d.<\/p>\n\n\n\n

Para finalizar, el Magistrado Benjam\u00edn Rubio Ch\u00e1vez, detall\u00f3 que el
proyecto se sustenta en tres pilares: defensa penal, asesor\u00eda jur\u00eddica y
asesor\u00eda jur\u00eddica intercultural. Finalmente, en materia de asesor\u00eda
jur\u00eddica intercultural destac\u00f3 la apertura de por lo menos 30 Casas de
Asesor\u00eda Intercultural en el pa\u00eds en las diversas regiones, adem\u00e1s de la
ya inaugurada en Huejutla, Hidalgo.<\/p>\n\n\n\n
