Esta ley, nombrada en memoria del actor Octavio Oca\u00f1a, tiene como objetivo principal castigar severamente a quienes difundan im\u00e1genes de cad\u00e1veres de forma dolosa.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-7134 size-large aligncenter\" src=\"https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luz-ma-hernandez-hoy-3-1024x682.jpg\" alt=\"\" width=\"640\" height=\"426\" srcset=\"https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luz-ma-hernandez-hoy-3-1024x682.jpg 1024w, https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luz-ma-hernandez-hoy-3-300x200.jpg 300w, https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luz-ma-hernandez-hoy-3-768x512.jpg 768w, https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luz-ma-hernandez-hoy-3.jpg 1280w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p>La Ley Oca\u00f1a establece penas de cuatro a ocho a\u00f1os de c\u00e1rcel y multas de 500 a mil d\u00edas de la Unidad de Medida y Actualizaci\u00f3n (UMA) para aquellos que violen la privacidad y dignidad de las personas fallecidas al difundir im\u00e1genes de sus cuerpos sin vida. Adem\u00e1s, se prev\u00e9n agravantes de penas de tres a siete a\u00f1os si los responsables son servidores p\u00fablicos.<\/p>\n<p>La promovente de la iniciativa, la diputada Luzma Hern\u00e1ndez Berm\u00fadez, cit\u00f3 que esta iniciativa aprobada \u201ctiene como\u00a0prop\u00f3sito\u00a0fundamental salvaguardar la dignidad y honra p\u00f3stuma de toda persona que pierde la vida, as\u00ed como garantizar el acceso a la justicia a terceros, ante pr\u00e1cticas il\u00edcitas cometidas, tanto por personas servidoras p\u00fablicas como por cualquier otra persona\u201d.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-7135 size-large aligncenter\" src=\"https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-2-1024x682.jpg\" alt=\"\" width=\"640\" height=\"426\" srcset=\"https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-2-1024x682.jpg 1024w, https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-2-300x200.jpg 300w, https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-2-768x512.jpg 768w, https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-2.jpg 1280w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p>Es importante destacar que si las v\u00edctimas son mujeres, ni\u00f1as, ni\u00f1os, adolescentes o personas en situaci\u00f3n de vulnerabilidad, las penas podr\u00edan incrementarse hasta una mitad, alcanzando sanciones de hasta 12 a\u00f1os de prisi\u00f3n.<\/p>\n<p>La iniciativa de la Ley Oca\u00f1a surgi\u00f3 a ra\u00edz de casos tr\u00e1gicos como el del actor Octavio Oca\u00f1a y de Ingrid Escamilla, cuyas im\u00e1genes fueron difundidas irresponsablemete por servidores p\u00fablicos, vulnerando as\u00ed sus derechos fundamentales incluso despu\u00e9s de su fallecimiento.<\/p>\n<p>La diputada Luzma Hern\u00e1ndez Berm\u00fadez ha dado seguimiento puntual y ha liderado este esfuerzo legislativo con el objetivo de salvaguardar la dignidad y honra p\u00f3stuma de todas las personas que pierden la vida, garantizando al mismo tiempo el acceso a la justicia para terceros afectados por pr\u00e1cticas il\u00edcitas.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-7136 size-large aligncenter\" src=\"https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-4-1024x683.jpg\" alt=\"\" width=\"640\" height=\"427\" srcset=\"https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-4-1024x683.jpg 1024w, https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-4-300x200.jpg 300w, https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-4-768x512.jpg 768w, https:\/\/redamlo.com\/wp-content\/uploads\/2023\/10\/luzma-hernandez-hoy-4.jpg 1280w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p>Adem\u00e1s de la Ley Oca\u00f1a, los diputados mexiquenses tambi\u00e9n han aprobado modificaciones a la Ley Ingrid para evitar ambig\u00fcedades y asegurar un mayor respeto a la dignidad de las personas fallecidas.<\/p>\n<p>Estas medidas son parte del compromiso del Estado de M\u00e9xico para combatir la exposici\u00f3n medi\u00e1tica irrespetuosa de las v\u00edctimas de homicidio o feminicidio.<\/p>\n<p>La diputada Luzma Hern\u00e1ndez Berm\u00fadez expres\u00f3 su profundo compromiso con la justicia y los derechos humanos al ser la promovente de \u00e9sta iniciativa, la cual marca un paso significativo hacia un M\u00e9xico m\u00e1s justo y respetuoso a los derechos humanos de las v\u00edctimas y sus familiares, siendo \u00e9sta una iniciativa de vanguardia a nivel Nacional.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La iniciativa aprobada tiene como\u00a0prop\u00f3sito\u00a0fundamental salvaguardar la dignidad y honra p\u00f3stuma de toda persona que&#8230;<\/p>\n","protected":false},"author":1,"featured_media":7133,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[6],"tags":[2580,2581,59,2582],"class_list":["post-7132","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-estados","tag-congreso-del-estado-de-mexico","tag-diputada-luzma-hernandez","tag-edomex","tag-ley-ocana"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>El Congreso Mexiquense Aprueba &quot;Ley Oca\u00f1a&quot;
