{"id":6896,"date":"2023-06-14T14:22:13","date_gmt":"2023-06-14T20:22:13","guid":{"rendered":"https:\/\/redamlo.com\/?p=6896"},"modified":"2023-06-14T14:22:13","modified_gmt":"2023-06-14T20:22:13","slug":"proyecto-en-suprema-corte-de-justicia-afectaria-recaudacion-de-hacienda-publica-hasta-por-10-mil-millones-de-pesos","status":"publish","type":"post","link":"https:\/\/redamlo.com\/index.php\/2023\/06\/14\/proyecto-en-suprema-corte-de-justicia-afectaria-recaudacion-de-hacienda-publica-hasta-por-10-mil-millones-de-pesos\/","title":{"rendered":"PROYECTO EN SUPREMA CORTE DE JUSTICIA AFECTAR\u00cdA RECAUDACI\u00d3N DE HACIENDA P\u00daBLICA HASTA POR 10 MIL MILLONES DE PESOS"},"content":{"rendered":"<p>El presidente Andr\u00e9s Manuel L\u00f3pez Obrador sostuvo que la recaudaci\u00f3n de la Hacienda P\u00fablica resultar\u00eda afectada si la\u00a0<strong>Suprema Corte de Justicia de la Naci\u00f3n (SCJN)<\/strong>\u00a0aprueba un proyecto del ministro Luis Mar\u00eda Aguilar Morales a favor de Gustavo C\u00e1rdenas Fuentes, representante legal de<strong>\u00a0Obses de M\u00e9xico S.A. DE C.V.<\/strong>, empresa ligada a Genaro Garc\u00eda Luna, exsecretario de Seguridad P\u00fablica en el sexenio de Felipe Calder\u00f3n.<\/p>\n<blockquote><p>\u201cHay un caso que nos importa mucho. Aprovecho para hacer un llamado a los ministros de la Corte porque hoy van a resolver sobre un tema fiscal que si no lo revisan a fondo y resuelven por influyentismo, por consigna, van a da\u00f1ar la Hacienda P\u00fablica\u201d, subray\u00f3 en conferencia de prensa matutina.<\/p><\/blockquote>\n<p><iframe loading=\"lazy\" title=\"Obras hidr\u00e1ulicas garantizan derecho al agua. Conferencia presidente AMLO\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/_u_0GYw0h4M?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>El mandatario indic\u00f3 que la informaci\u00f3n sobre este caso est\u00e1 disponible al pueblo porque el Gobierno de M\u00e9xico no permite la corrupci\u00f3n ni encubre a nadie.<\/p>\n<p>El asunto a resolverse este mi\u00e9rcoles en la SCJN surgi\u00f3 cuando el\u00a0<strong>Servicio de Administraci\u00f3n Tributaria (SAT)<\/strong>\u00a0revis\u00f3 en 2016 las cuentas de C\u00e1rdenas Fuentes, quien form\u00f3 parte de una organizaci\u00f3n criminal conformada por su sobrino Luis C\u00e1rdenas Palomino, exdirector de Seguridad Regional de la extinta Polic\u00eda Federal y Garc\u00eda Luna.<\/p>\n<p>Colabor\u00f3 para que C\u00e1rdenas Palomino recibiera recursos en 2017 de la empresa Adamantium Private Services, provenientes de Nunvav Technologies Inc, compa\u00f1\u00eda empleada por Garc\u00eda Luna que enviaba recursos a Estados Unidos. Mediante dicho esquema se desvi\u00f3 un monto total de 745.9 millones de d\u00f3lares.<\/p>\n<p>A pesar de interponer un amparo para impedir la visita de la autoridad fiscal, el SAT logr\u00f3 determinar que C\u00e1rdenas Fuentes dej\u00f3 de pagar impuestos por m\u00e1s de 163 millones de pesos desde 2015. Actualmente la cantidad asciende a los 342 millones de pesos.<\/p>\n<p>En desacuerdo, interpuso un juicio de nulidad que, luego de ser resuelto, lo declar\u00f3 v\u00e1lido. Posteriormente, promovi\u00f3 un amparo negado por un Tribunal Federal; esa sentencia fue recurrida y del conocimiento del ministro Luis Mar\u00eda Aguilar Morales, que present\u00f3 tres proyectos, el 10 de agosto y el 13 de octubre de 2022 y el 19 de abril de 2023, proponiendo desechar el recurso de revisi\u00f3n en favor del SAT y del cr\u00e9dito fiscal, sin embargo, las tres veces lo retir\u00f3.<\/p>\n<p>En mayo pasado, el ministro Aguilar cambi\u00f3 el criterio y present\u00f3 un nuevo proyecto encaminado ahora a favorecer al deudor.<\/p>\n<blockquote><p>\u201c\u00bfC\u00f3mo un ministro cambia tres veces su criterio? O mejor dicho, tres veces presenta un proyecto con un criterio y luego cambia su argumentaci\u00f3n de manera inexplicable. \u00bfC\u00f3mo no lo vamos a saber? Porque es p\u00fablico\u201d, cuestion\u00f3 el jefe del Ejecutivo.<\/p><\/blockquote>\n<p>El procurador fiscal de la Federaci\u00f3n, F\u00e9lix Arturo Medina Padilla, explic\u00f3 que, de aprobarse este criterio por una mayor\u00eda de cuatro votos de ministras y ministros en la SCJN, ser\u00eda vinculante para los tribunales del pa\u00eds, afectando procedimientos en curso y la recaudaci\u00f3n federal hasta por 10 mil millones de pesos.<\/p>\n<blockquote><p>\u201cLos recursos p\u00fablicos que se dejan de percibir no pueden ser destinados a salud, a escuelas, a alimentaci\u00f3n o a los\u00a0<a href=\"https:\/\/programasparaelbienestar.gob.mx\/\" target=\"_blank\" rel=\"noopener\">Programas para el Bienestar<\/a>\u201d, enfatiz\u00f3.<\/p><\/blockquote>\n<p>Hizo referencia que C\u00e1rdenas Fuentes se benefici\u00f3 de contratos p\u00fablicos de la\u00a0<strong>Tesorer\u00eda de la Federaci\u00f3n<\/strong>, de gobiernos estatales, de la Polic\u00eda Federal y del Servicio de Protecci\u00f3n Federal por 281.9 millones de pesos entre 2010 y 2016.<\/p>\n<p>Entre sus bienes, dijo, se encuentra un Ferrari 458 Spider 2014 con un valor de 5.6 millones de pesos.
