{"id":237,"date":"2019-08-06T12:48:35","date_gmt":"2019-08-06T17:48:35","guid":{"rendered":"http:\/\/redamlo.com\/?p=237"},"modified":"2019-08-06T12:48:35","modified_gmt":"2019-08-06T17:48:35","slug":"scjn-avala-interrupcion-de-embarazo-por-violacion-sin-denuncia-previa","status":"publish","type":"post","link":"https:\/\/redamlo.com\/index.php\/2019\/08\/06\/scjn-avala-interrupcion-de-embarazo-por-violacion-sin-denuncia-previa\/","title":{"rendered":"SCJN avala interrupci\u00f3n de embarazo por violaci\u00f3n sin denuncia previa"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">La <\/span><b>Suprema Corte de Justicia de la Naci\u00f3n (SCJN) <\/b><span style=\"font-weight: 400;\">aval\u00f3 la Norma Oficial Mexicana <\/span><b>(NOM) 046-SSA2-2005<\/b><span style=\"font-weight: 400;\"> que establece a todos los hospitales de \u00edndole p\u00fablico interrumpir los embarazos resultados de violaci\u00f3n sin necesidad de que la v\u00edctima denuncie el delito ante el Ministerio P\u00fablico.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dicha norma establece que:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">El caso de ni\u00f1as menores de 12 a\u00f1os, la s<\/span><b>olicitud se realizar\u00e1 por conducto del padre y\/o la madre<\/b><span style=\"font-weight: 400;\">, o a falta de estos, su tutor.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">El personal de salud que participe en el procedimiento de interrupci\u00f3n voluntaria del embarazo <\/span><b>no estar\u00e1 obligado a verificar el dicho de la solicitante<\/b><span style=\"font-weight: 400;\">, tambi\u00e9n se elimina el requisito de la autorizaci\u00f3n previa de la autoridad competente.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Esta <\/span><b>norma es una forma de proteger a las mujeres y a las ni\u00f1as<\/b><span style=\"font-weight: 400;\">, consider\u00f3 que el Art\u00edculo 51 lo que quiere es que estas normas oficiales no inicien con un procedimiento muy abigarrado, cuando lo que urge es que se modifiquen para que sean claras y expeditas.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Adem\u00e1s, el personal de salud que participe en el procedimiento dicho proceso quir\u00fargico no estar\u00e1 obligado a verificar la petici\u00f3n de la solicitante.<\/p>\n","protected":false},"author":2,"featured_media":239,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-237","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.1 -
